A: Maybe. Maybe not. It varies from one malpractice insurance policy to the
next. Even policies which claim to offer legal representation for defense of your professional
license may not provide an attorney who is an expert in the defense of RN Guardian licenses
and California Board of Registered Nursing (BRN) matters, the way RN Guardian attorneys are. Also,
with legal represenation provided through malpractice insurance, you may not have any access to an
attorney until just prior to an administrative hearing set by the BRN, compared to representation
through RN Guardian membership, where an attorney is provided from the very begining of any
investigation by BRN.
Q: Will RN Guardian help me during a BRN investigation?
A: Yes. Once coverage has been granted, RN Guardian will provide
advice, consultation, and other representational services to help you deal with a BRN
investigation. This is the case even if the investigation never leads to any form of
charges or allegations of misconduct. Your RN Guardian attorney will represent you
during any interview or other fact finding procedure.
Q: Will I get a lawyer to represent me?
A: Yes. RN Guardian will provide you a lawyer who is an expert in
licensing investigations and appeals. Your lawyer will be able to focus on you and
your appeal and provide you the best representation possible.
Q: Is my RN Guardian membership affected if I change jobs?
A: No. Your RN Guardian membership is wholly independent from your
employment. You can change jobs or stop working altogether and still maintain the
benefits through RN Guardian.
Q: Will RN Guardian protect me if I belong to a union or employee
association?
A: Yes. Your RN Guardian benefits are supplemental to any benefits
or representation you receive from your union or employee association. RN Guardian is
designed to protect your license and has expert lawyers who are trained to do just that.
